Nnamdi Kanu, the leader of the Indigenous People of Biafra, or IPOB, has filed a Direct Criminal Complaint against two prosecution witnesses during his trial, ahead of the November 20 ruling.
Kanu asserted that “they wilfully gave false evidence on oath” and named the two witnesses as Mr. TAA, also known as PW1, and Mr. BBB, also known as PW2.
Sections 156, 158(1), 159(1), and 160 of the Penal Code, Section 88 of the Administration of Criminal Justice Act, 2015, and Sections 34 and 36 of the 1999 Constitution (as amended) served as the foundation for the complaint, which was sent to the Chief Magistrate Court of the FCT High Court.

It states: “Mazi Nnamdi Kanu, a Nigerian citizen of Umuahia, Abia State, who is a Christian adult and leader of the Indigenous People of Biafra, or IPOB, and who has been detained by the Department of State Services, or DSS, since June 29, 2021, hereby hereby sincerely assert and protest the following:
During the hearing and trial-within-trial in the Federal Republic of Nigeria v. Nnamdi Kanu (FHC/ABJ/CR/383/2015) case at the Federal High Court in Abuja on various dates between May and July 2025, Mr. TAA and Mr. BBB, who were called as witnesses by the prosecution in my trial, wilfully gave false testimony under oath knowing it to be false and/or not believing it to be true and material to the admissibility of the 2015 and 2021 statements. This is a violation of sections 156, 158, and 159 of the Penal Code.
“That Mr. TAA, on oath, said on page 352 of the Certified True Copy of proceedings dated June 26, 2025: ‘I cannot recall. When questioned if he knew Mr. Brown Ekwoaba, the Assistant Director (Investigations) at the DSS National Headquarters in Abuja, who personally oversaw the complainant’s detention and interviews in October and November 2015, he said, “I didn’t know any other Mr. Brown, my lord.”
The IPOB chief called TAA’s denial “false.”
“That Mr. TAA’s denial is untrue, as demonstrated by: Prince Emmanuel Kanu’s affidavit (Exhibit C), which attests to six (6) visits to the complainant in Mr. Brown Ekwoaba’s office at Yellow House, Third Floor, between October 2015 and January 2016; Benjamin Madubugwu’s affidavit (Exhibit D), which attests to interviews with Mr. Brown Ekwoaba and three others in the same office in November 2015; and public records attesting to Mr. Brown Ekwoaba’s position as Assistant Director, Directorate (Investigations) (2015–2020), which was later renamed State Director (Edo & Kwara).
Despite having previously testified (pages 184–188) that he oversaw the complainant’s video interview at DSS Headquarters on July 17, 2021, MR. BBB declared under oath on page 202 of the Certified True Copy of proceedings: “I have not met him before except in this court.”
“That both witnesses provided materially false testimony to hide the true chain of custody of the 2015 and 2021 statements, despite being protected by masks and screens ordered by the trial court.”
